I am a Canadian citizen married to a man from Oklahoma. We have been married since November 2006. I am currently employed and living here in Canada for now as he just finished up basic training in the National Guard. I want to move myself and my three children down to the United States soon but am unsure as to the paperwork that I need to have completed. I have custody of my children and I do not want to give up my Canadian citizenship when I move there. I want myself and my children to have permanent residency. Do I need the permission of the father of my children to take them? What paperwork do I need to have done to get it and does it take a long time to get? And am I the one that is to complete it or is that something my husband should be doing. I love my husband and am so tired of being so far apart. If anyone has answers for me they would be greatly appreciated. Thanks, Jocelyn

If you want the benefits of living in the U.S., become a citizen. If you want to stay a Canadian citizen, stay there. What do you have to gain by keeping your Canadian citizenship? I gave up mine 30 years ago and have never had second thoughts.

I retired from the Immigration Service in 2006 and now I work for a US company in West Africa.

Your situation appears to be a very common one. To join your husband he must file a petition for you. You or he can go to the USCIS web site: www.uscis.gov or do a search for US Citisenship and Immigration Service and click on forms. You should be able to get to the I-130 and other information.

As far as your children, I do not think that you will have any problem getting them to the US since you have custody.

You will need all documents showing your current marriage, husband's citizenship, prior divorces or proof of termination of the marriage(s), custody of your children, and other documents that wil be indicated on the form and when you complete the immigrant visa form (when the National Visa Center (NVC) takes over your case after USCIS approves your petition it will be sent to the NVC and you will get more paperwork - it's not a short road so you must have patience and follow all instructions -or you could hire someone to complete the paperwork for you.

Also your Canadian citizenship does not have to be relinquished until you want to. Maybe if you naturalize as as US citizen. Check with the Canadian Forein Ministry for rules on this.
